Terms of service

The words, pictures, code and design on this site are ours. You are welcome to read it, link to it, and quote a line of it with credit. You may not copy it wholesale, scrape it, or pass our work off as somebody else's.

Please do not use the site to mislead anyone about who we are or what we do — putting our name on work that is not ours, for example, or implying we recommend something we have never seen.

Asking us a question, booking an intro call, or receiving a quote commits neither of us to anything. We are not obliged to take the work and you are not obliged to give it to us.

An engagement begins when there is a written proposal that we have both signed. Until that exists, a price we have given is an estimate of what the work would cost — it is not a binding offer, and nothing on this website is.

These are the terms printed on the pricing page. They are repeated here word for word so that they are in one place, and there is nothing in this list that is not already there:

• Builds are 50% at kickoff, 50% at launch.
• Care plans have a 12-month term from launch, billed monthly. After the first 12 months they continue month to month, and you can cancel with 30 days' notice. Prepay the first year and save 10%. Every plan includes hosting and domain renewals.
• You own and pay for your own Shopify, Stripe, and domain accounts. Clean handoff by design.
• Plans include a set number of change hours per month; unused hours don't roll over. Work beyond scope is $150/hr, quoted before we start.
• Standard requests: next business day. Emergencies (site down, checkout broken) are defined in writing and handled first.
• Brochure sites include the first year of hosting and the domain, a 60-day bug-fix warranty and easy updates: send us what to change and we make it for you. After the first year, hosting and the domain are $180 a year without a care plan. Premium domains (registry price over $50 a year) are billed at cost on top.
• Email inboxes come from your own email provider and aren't part of hosting or the care plan.

Whatever your signed proposal says takes precedence over this page. If the two ever disagree, the proposal is the one that counts, and we would want to know about the difference.

We are responsible for our own work. If we build something badly, we fix it — that is what the warranty and the care plan are for, and we would rather hear about it than not.

We are not responsible for things outside our control. If a platform you own an account with changes its rules, raises its prices or has an outage; if changes are made to your accounts by someone other than us; or if something happens that nobody could reasonably have prevented — we will help you deal with it, but we cannot be held liable for what it costs you.

Where we are liable, our liability is limited to what you have paid us for the work in question. We are not liable for lost profits or lost business. None of this limits anything that cannot lawfully be limited.

These terms are governed by the law of the State of Ohio, and any dispute belongs in the courts of Ohio.
